Duties, Tariffs & Taxes
The Andean Community is a Customs Union because the goods of
its member countries circulate unimpededly throughout its territory free of
duties of any sort, while imports from outside the Subregion pay a common
tariff.
The Andean Customs Union has been in operation since 1995, when the Common
External Tariff (CET) approved by Colombia, Ecuador and Venezuela at the basic
levels of 5, 10, 15 and 20 percent came into effect. Bolivia enjoys preferential
treatment and only applies levels of 5 and 10 percent, while Peru did not sign
that agreement.
In the
Santa
Cruz Declaration of January 2002, the Andean Presidents stipulated that
"Bolivia, Colombia, Ecuador, Peru and Venezuela will apply a common
external tariff by December 31, 2003, at the latest.” Accordingly, the
Ministers of Foreign Affairs, Economy and the Treasury, Foreign Trade and
Agriculture of the five CAN member countries on October 14, 2002 decided on the
CET that is shown in Annex I to Decision 535. On April 14, 2003, the Andean
countries put the finishing touches to the agreements for the adoption of a CET,
thus bringing an important stage in the integration process to an end.

Peru belongs to the World
Trade Organization (WTO) and the World Intellectual Property Organization (WIPO).
It is also a signatory to the Paris Convention, Bern Convention, Rome
Convention, Phonograms Convention, Satellites Convention, Universal Copyright
Convention, the World Copyright Treaty, the World Performances and Phonographs
Treaty and the Film Register Treaty. After two years on the United States
government's "Priority Watch List" under the Special 301 provisions of
the 1988 Trade Act, Peru was lowered to the “Watch List” in 2001 following
steps on the part of the government of Peru to address intellectual property
rights (IPR) piracy. Peru remains on the Watch List due to concerns about
continued high rates of copyright piracy and inadequate enforcement of IPR laws,
particularly with respect to the relatively weak penalties that have been
imposed on IPR violators. Other factors contributing to continued
placement on the “Watch List” include Peru’s revocation of second-use
patent protection for pharmaceuticals and a lack of protection for confidential
test data that is submitted for the marketing approval of pharmaceutical and
agrochemical products.
The Peruvian government had
hoped that the Andean Community's September 2000 adoption of Decision 486 as the
IPR regime for the region would resolve Peru's outstanding discrepancies with
the WTO TRIPS Agreement. U.S. pharmaceutical companies, however, are
concerned that Decision 486 is not sufficiently explicit regarding the
confidentiality of data included with patent applications, thereby opening the
way to the possible erosion of protections for such information. In
addition, international pharmaceutical companies expressed particular concern
that ambiguities in Decision 486 regarding the patentability of "second
use" innovations could undermine the Peruvian government's ability to
enforce second use patents. The Andean Community Secretariat ruled in 2001
that Peru violated Decision 486 by issuing "second use" patents.
The Andean Tribunal upheld the Secretariat’s 2001 ruling requiring Peru to
stop issuing second-use patents. In late 2002, the government of Peru
succumbed to Andean Community pressure, in the form of trade sanctions, and
rescinded its protection of second-use patents.
Peru’s 1996 Industrial
Property Rights Law provides an effective term of protection for patents and
prohibits devices that decode encrypted satellite signals, along with other
improvements. Peruvian law does not provide for pipeline protection for
patents or protection from parallel imports. Although Peruvian law provides for
effective trademark protection, counterfeiting of trademarks and imports of
pirated merchandise are widespread.
Peru’s Copyright Law is
generally consistent with the TRIPS Agreement. However, textbooks, books
on technical subjects, audiocassettes, motion picture videos and software are
widely pirated. While the government, in coordination with the private
sector, has conducted numerous raids over the last few years on large-scale
distributors and users of pirated goods and has increased other types of
enforcement, piracy continues to be a significant problem for legitimate owners
of copyrights in Peru.
