Pakistan's legal system offers improving, yet incomplete,
protection for the acquisition and disposition of property rights. The 1979
Industrial Property Order safeguards industrial property in Pakistan against
compulsory acquisition by the government, even in the public interest, without
sufficient compensation in accordance with the provisions of the law. This Order
protects both local and foreign investment. Foreign Private Investment Promotion
and Protection Act 1976 guarantees remittance of profits earned through sale and
appreciation in value of property.
Nonetheless, the Office of the U.S. Trade Representative has placed Pakistan on
the Special Section 301 Watch List under the Trade Act of 1988 for the past
several years because of inadequate intellectual property rights protection.
Areas of specific concern include optical media piracy (Eight optical disc
factories in Pakistan currently produce an estimated 70 million unlicensed discs
annually, the majority of which are exported); unauthorized reproduction of U.S.
printed works; and textile design piracy. A general complaint is that, even
where Pakistan's intellectual property laws appear to provide adequate
protection, enforcement is slow, sporadic, and ineffective. Weak enforcement is
partially attributed to the division of responsibilities for copyrights,
patents, and trademarks among a variety of government ministries. Government
officials have announced plans to consolidate IPR agencies to improve
enforcement. The proposed IPR agency still awaits Cabinet approval.
Intellectual Property Rights: Pakistan is a member of both the Universal
Copyright and Bern Conventions and it is in the final stages of acceding to the
Paris Convention. In 2000 and 2001, Pakistan enacted five ordinances to meet its
copyright, industrial designs, integrated circuits, patents and trademark
obligations under the WTO agreement on Trade Related Intellectual Property
(TRIPS). The government copyright office is a department of the Ministry of
Education. The new copyright law protects literary works, including works on
humanity, religion, social and physical sciences, tables, compilation of data,
computer programs and artistic work, including phonograms, and contains
penalties for copyright infringement. These rights extend for 50 years from the
year of creation or performance. Provisions of the new copyright law which
permit the government to grant a license to reprint, translate, adapt or publish
any text or book on a non- profit basis in the public interest is
TRIPS-inconsistent. A correction is pending final incorporation into the legal
code.
Registration of patents and designs is administered by the Patents Office, a
department of the Ministry of Industries. Patents are granted for up to 20 years
from the date of application. Legal remedies including injunctions are available
in the case of patent infringement. Trademarks are registered under the 2001
Trade Marks Ordinance through the Trademark Registry, a department in the
Ministry of Commerce. Trademarks are registered for a 10-year period from the
date of registration and may be renewed for a further 10 years. The Industrial
Designs Law provides for the registration of designs for a period of 10 years,
with the possibility of extending the registration for two additional 10-year
periods. The Law for Layout Designs of Integrated Circuits provides for
protection of layout designs for ten years starting from its first commercial
exploitation anywhere in the world. Penalties and legal remedies are also
available in case of infringement on industrial designs, layout designs and
trademarks. Implementing rules to enforce these ordinances remain incomplete.
